This Terms of Service Agreement is made between Raj Softech Solutions India Private Limited (hereinafter referred to as RajSoftechSolutions.com) Website and you, is made effective as of the date of electronic acceptance.

In these terms, a reference to "website", "webpage", "we", "us", "our" and "ours" refers to www.rajsoftechsolutions.com and its admin and founders.

In these terms, a reference to "subscriber(s)", "customer(s)", "member(s)", "registrant(s)", "person(s)", "visitor(s)", "reader(s)", "you", and "your(s)" refers to the members and/or other persons and/or any other legal entity visiting our Website and using or intend to use our services purchased or accessed through our Website along with other policies as follows Privacy Policy, Disclaimer Policy.

In these terms, "materials" defines the following meaning such as "text", "graphics", "images", "audios", "videos", "software", "applications", "scripts" and any other forms of information's which is able to store in a computer (or) displayed in this website.

Therefore, you hereby declare that you agree to these terms and conditions before and when using our website or any services related to Web Hosting, Domain Registration, and Digital Marketing Services. Nothing in this agreement shall be deemed to confer any third party rights or benefits. You also agree to bound by our Privacy Policy and Disclaimer Statement.  RajSoftechSolutions.com at its sole and absolute discretion, may change or modify any part or whole of this agreement or any policies which are incorporated herein, at any time and such changes or modifications shall take immediate effect upon posting on this site.

You acknowledge and agree that RajSoftechSolutions.com may notify any such changes or modifications by updating this page on this site by posting the changes and shall constitute your acceptance of this agreement as last revised. Dates may be published on this page.

1. Eligibility

2. Account Setup

In order to access the features of our site or use any services found at this site, you will have to create an account. Please ensure all the information you shared or submitting to RajSoftechSolutions.com to create an account is accurate, current and complete and you should represent and warrant that you will keep your account information updated and complete. At any situation or reason, if we believe that the information is untrue, inaccurate, out-of-date or incomplete, RajSoftechSolutions reserves the right at its sole discretion to suspend or terminate your account.

2.1. Domain Name Registration

RajSoftechSolutions.com provides domain registration services and the prices displayed on our website are the original prices of our registering authority, which is exclusive of taxes. The registrant must provide accurate and complete registration information with active and current contact details as well as communication address that includes full name, postal address, email address, and contact number (mobile/landline) if available during the time of domain registration.

Failing to do so will have a grace period of 7 days by which the registrant should update the correct details in our system and upon failure to update information during that period of 7 days or failed to respond to our emails or any other communication methods such as phone calls for over fifteen (15) days by RajSoftechSolutions.com staff or any authorized person will be considered a material breach of the registrant contract and it may lead to account suspension and/or cancellation of the registered domain name.

The registered domain name is intended to license the use of a domain name only by the direct authorization of the registrant and holds responsibility for the operation of the respective domain name by any other unauthorized use of the domain names. The registrant, therefore, shall indemnify and hold harmless the registry operator and its directors, officers, staffs, and agents from and against any and all claims, damages, liabilities, and any or all other financial expenses (including legal fees) arising out of or related to the registered name holder’s domain name registration.

2.2. Domain Name Transfer

RajSoftechSolutions.com will do the domain transfer on courtesy of serving our customers to the best possible level. We cannot guarantee that every transfer of domains names to our account from other accounts. When transferring a domain name from another service providers may not be successful due to some technical errors such as wrong EPP code or blocking the domain from transfer for any reason. It is entirely the user’s responsibility to confirm the domain renewal and domain transfer to RajSoftechSolutions.com.

2.3. Domain Name Renewal

As a courtesy, all our customers will be reminded 15 days prior to the date of expiration of the subscriber’s domain name, if registered with RajSoftechSolutions.com or if transferred to and registered with RajSoftechSolutions.com. We will reach you by sending an email to your registered email address on our file and request you to process your payment before the expiration date through any applicable methods on the date to renew your domain name. Also, the customer acknowledges and confirms that the obligation in domain renewal is solely and exclusively the responsibility of the customer and does not obligate RajSoftechSolutions.com in any means or terms. The customer does release RajSoftechSolutions.com from any and all liability for the failure of domain renewal. However, in the event of the expired domain will hold a grace period up to 7 days as a courtesy and post 7 days will be placed in redemption for 30days. Post 30days the domain will be inaccessible and unable to register elsewhere and in this case, the customer will have to pay more applicable fees/charges as imposed by the concerned registering authority on a date.

2.4. Web Hosting Services

RajSoftechSolutions.com also offers the best-in-class web hosting services for our customers. We offer different hosting such as Shared hosting, Virtual Private Server Hosting, Dedicated Hosting and Cloud Hosting on both Linux and Windows Environment. Customers can choose any one or more than hosting account according to their business needs and we will charge on all hosting accounts registered by our customers. As a courtesy and not as an obligation, RajSoftechSolutions.com reminds its customers fifteen (15) days prior to the expiration of our subscribers hosting account. If the subscriber has already any credit balance, RajSoftechSolutions.com at its own discretion reserves rights to renew the service that is reaching expiration if the subscriber maintains sufficient funds to cover the charges. The renewal of Web Hosting Account for the same duration initially selected, will be charged at the current dated non-promotional price applicable and the same will be charged as applicable fee to subscribers current payment method on file.

3. Content Policy

By using the hosting services whether it may be any form of hosting such as shared hosting, VPS hosting, dedicated hosting, cloud hosting and on any platforms such as Linux and/or windows, you agree that you will not host, upload, display, publish, transmit, add, edit and/or modify any materials that belong to another person or entity to which the user does not have any rights unless you have written consent from the original owner of that copyrighted material. You agree not to host, display, upload, modify, publish, transmit, update or share any information that

— is categorized as the harmful, aggressive, offense, harassing, blasphemous, obscene, libelous, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful activities as dictated by the respective country law.

— harm minors in any way

— infringes any or others patent, trademark, copyright or other proprietary rights

— violates any law in force

— misleading information

— impersonate another person

— contains viruses or any other computer code, files or programs to interrupt, destroy or limit any computing resource

— threatens the unity, integrity, defense, security or sovereignty of the respective country or anything that cause a public nuisance, or will lead to any political disorder.

You also entitled for the safety and security of any user information you collect through your registered domain. You also agree that you use the site based on obeying the applicable laws and with comply of this agreement and other legal rules and regulations.

You promise that you will not collect or harvest any user content or any personally identifiable information about any person or entity without their prior written consent. Examples of unacceptable material on all our servers include;

3.1. Content Monitoring

RajSoftechSolutions.com does not screen our user hosted on any domains registered by us and in some special cases, RajSoftechSolutions.com reserves the full rights to screen the user content for making decisions on whether any item of the user content founds to violate any terms and conditions of this agreement. If we found any such violations (as determined by RajSoftechSolutions.com at its sole discretion), we reserve the full rights to remove any such item of the respective user content (hosted on our servers) and/or may lead to termination of your services and server and other accounts with RajSoftechSolutions.com at any time with and/or without prior notice. We may permanently terminate a user’s access to our site or any services from RajSoftechSolutions.com if we believe on any valid reason that the user is a repeated offender. The decision is at our sole and absolute discretion and we reserve the rights to remove and destroy any data or files or contents stored/hosted by you on our servers.

4. Zero Tolreance Spam Policy

Spamming refers to the term of sending unsolicited bulk emails, messages over the Internet. We strictly don’t tolerate such spam as it may affect our loyal customers and to maintain the integrity of our platform and our network, and to provide continued uninterrupted service to our other subscribers, we currently don’t offer our services for such purpose. In this case, no refunds will be provided.

5. Payment Information (Refund Policy & Cancellation Policy)

The customer agrees to pay all applicable fees/charges during the registration process for the first time and/or renewal, subject to these terms. You hereby agree to update all your account related information and contact information for billing purpose. Every customer is allowed to maintain a credit balance in their user accounts for the use of any services including hosting, domain registration, digital marketing services for the future purpose. To do so, the respective customer has to make a request to our billing team by sending a direct email to billing@rajsoftechsolutions.com with all account details such as username, domain name, hosting details or any other services being used by the customer. You should send a credit request email to our billing department 30 days prior before the expiration of your current service. However, all credit requests will take 30 days processing time.

Note: Credits are not refundable or non-transferable and only can be used towards future billing purpose by RajSoftechSolutions.com.

5.1. Cancellations

The Customer agrees to notify RajSoftechSolutions.com about customer’s intent to cancel automatic renewal at least Thirty (30) business days prior to the date of expiration (both account or domain expiration) by sending an email through account dashboard or phone. The same request should be accepted only upon the verification of the original owner of the respective hosting account and/or domain registrant confirmation, as determined by RajSoftechSolutions.com.

5.2. Refund Policy

No refund will be processed if you found violated or suspected violation of this agreement. However, our customers have the rights to cancel his/her/its services at any time, before or after account setup within the time frame of 15 Days from the date of activation or registration. In this case, we provide 15 days money back guarantee only for our Web Hosting Services and the refund is not applicable for other purchases such as domain name registration, SSL certificate purchase, Domain privacy protection purchase etc.

Only first-time accounts are eligible for a refund, for example, if any customer had used our service anytime before and canceled and signed up again, is not eligible for any refund. The refund will be processed only on valid reasons and the entire decision is at our sole discretion. No refunds will be made if your service(s) are suspended or terminated for any reason. We do not process a refund for customers who have hosted illegal contents, copyrighted materials on our servers.

If any customer requires a refund for a valid reason, RajSoftechSolutions.com will process the same only for the amount we received through any payment system on file excluding the respective tax deductions. In this case, we cannot offer a refund to taxed amounts and also RajSoftechSolutions.com agrees to offer refund after deducting Rs.300 + Tax (if applicable) or 10% whichever is higher.

Dedicated servers and Virtual servers may levy additional setup fees and these charges are not eligible for a refund and we reserve the right to hold the same.

5.3. Non-refundable Fees

The fee or charges paid by our customer towards the purchase of SSL certificates, domain privacy, and domain names are non-refundable or non-transferable and in this case, we cannot process any refund request at any cause.

6. Backup and Data Loss

All the user contents including the websites and their contents, data, and applications will be stored on our backup server for 30 days from the current date. We provide this service for free to all our customers at no extra cost and in any special case, if the customer requires a long backup period, the same will be created for additional charges/fees in which the respective customer will be billed. By using our services, you, therefore, hold fully responsible for your data backup, and you agree to back up all of your content so that you can access and use it whenever needed.

Our backup services for shared and managed WordPress hosting services are configured to backup all accounts under 1GB (1024 MB). If the cpanel account goes beyond 1GB (1024 MB) of data, our automated setup will remove the cpanel account from our backup system. This limitation is in effect to maintain our system integrity. As a user, you have to manage your cpanel account frequently by removing unnecessary files and folders. We don't offer any backup services for VPS and Dedicated servers.

Raj Softech Solutions India Private Limited provides a backup service as a courtesy to protect our user data and files hosted on our server to some extent. However, Raj Softech Solutions India Private Limited does not take any means of responsibility for files and/or data on your account hosted on our servers. You should take proper backup of your data and files stored on our Hosting Server(s). We also inform you that we will not provide any backup for the accounts that have been suspended or terminated for any reason unless otherwise agreed in writing by Raj Softech Solutions India Private Limited.

RajSoftechSolutions.com does not warrant any user account or user content backup, and you agree to accept at your own risk. We also do not provide any guarantee for data loss that happened due to certain situations beyond our control including, without limitations, acts of any governmental body, war, insurrection, sabotage, armed conflict, embargo, fire, flood, or any other natural disasters, labor disturbance, interruption or delay in transportation, unavailability of or interruption or delay in telecommunications or third party service failures on any materials (including software, free scripts, chat, statistics integration, payment gateways, e-commerce software).

Other reasons include attacks by Viruses, DDoS, or hackers attacks in our RajSoftechSolutions.com network, scheduled maintenance, and system upgrade or emergency maintenance. Any defaults in Domain Name Registry services that are entirely outside the control of RajSoftechSolutions.com and registry propagation issues or domain expiration. Including the use of any scripts or coding (e.g., ASP, CGI, HTML, Perl, etc.), any negligence or willful misconduct against the terms and conditions, and acceptable use policy.

Issues with the integration of any third-party services, email marketing system. RajSoftechSolutions.com does not hold any means of responsibility for any kind of data loss due to your browser or DNS or any caching on which your website operates. If the customer failed to renew their account within 15 days after the expiration, all their contents will be deleted including backup contents as well, and in this case, we cannot guarantee you the backup data.

7. Usage Policy

RajSoftechSolutions.com offers a wide range of servers for the reliable use of our customers and we always strive to offer the best hosting experience to our customers. In some special cases, we do not allow the following conditions to execute:

• Excessive use or more of system resources for longer than 90 seconds. There are numerous activities that could cause such problems; these include CGI scripts, FTP, PHP, HTTP, etc.
• Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
• Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
• Run any software that interfaces with an IRC (Internet Relay Chat) network.
• Run any bit torrent application, tracker, or client. You may link to legal torrents off-site but may not host or store them on our shared servers.
• Participate in any file-sharing/peer-to-peer activities.
• Run any gaming servers such as counter-strike, half-life, battlefield1942, etc.
• Run cron entries with intervals of less than 15 minutes.
• When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”) use include(“include.php”)

7.1. Inodes

The use of more than 15,000 Inodes on any shared hosting account on our server may pose a potential warning on the first instance and if no action is taken further leads to suspension of the said account. The user accounts found to be exceeding the 100,000 inode limit will automatically be removed from our regular backup system to avoid over-usage. Every file (a webpage, image file, email, etc) on your account uses up 1 inode.

Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension. The primary cause of excessive inodes seems to be due to users leaving their catchall address enabled, but never checking their primary account mailbox. Over time, tens of thousands of messages (or more) build up, eventually pushing the account past our inode limit. To disable your default mailbox, login to cPanel and choose “Mail”, then “Default Address”, “Set Default Address”, and then type in: :fail: No such user here.

7.2. Backup Usage Limit

We provide guaranteed backup to our customers to a certain tolerable limit. Any file over 25MB of size will not be backed up on our regular backup servers and in the event of any failure of your live site, will not be recoverable. Any shared hosting account using more than the 1GB (1024 MB) of disk space will be removed from our off site weekly backup with the exception of Databases continuing to back up. We employ Raid protection to ensure the safety of backed up data on our servers.

7.3. CPU Usage

We have allocated the maximum limit of CPU usage for each shared hosting account. In the event of any account exceeding the limit (more than 10%) will lead to temporary account suspension. Continues repetition of such activity will lead to permanent suspension.

7.4. Email Usage

RajSoftechSolutions.com allows every shared hosting customer to send 100 outgoing emails per hour per domain. Post usage, the emails will be bounced back with an undeliverable error. If this happens, it will take at least 1 hour time before you restart to send emails.

7.5. Bandwidth Usage

Every customer was allowed a preset allowable monthly bandwidth allowance and it will vary depending on the hosting package you may purchase. Post usage of bandwidth will lead to account suspension until the start of next allocation. In special cases, if any customer requires more bandwidth, RajSoftechSolutions.com will provide additional bandwidth upon additional fee or charges which may be applicable during the time. Unused bandwidth will not be carried over to the next month.

8. Guarantees

8.1. Money Back Guarantee

15 Day money back guarantee is applicable only for hosting services and not any other services like domain registration, privacy protection, SSL certificate purchase and for digital marketing services. If the customer is not satisfied with our services within the first 15 days of your service, you will be given a full refund deducting necessary charges as mentioned in our refund policy. This is applicable only for first-time users only.

8.2. Uptime Guarantee

We always work 24/7 to give you the best and reliable services. We strive to bring 99.99% uptime on our network, but sometimes, for a number of reasons, the services may be unavailable to you. It is therefore acceptable and you acknowledge that due to the nature of complications in technologies, certain occasional unavailability of the services cannot be avoided. But we have the necessary streams to immediately bypass the defective segment and put the services live as soon as possible. Still other times, there are causes beyond our control like power failures, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network traffic, and other occurrences. We have not promised to provide you with uninterrupted service. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor’s network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services.

9. Responsibility

You are solely responsible for any activity that occurs on your account, whether authorized by you or not and RajSoftechSolutions.com will not be liable to any such obligations. You should keep your account information such as username, password, pin number(if any) and payment method(s) secure. It is your duty to notify RajSoftechSolutions.com about any breach of security or unauthorized use of your account. We will not be liable for any such loss that may occur due to such incidents. For security reason, we recommend you to change your password at least once three (3) months. You are completely responsible for any loss that may arise or incur by RajSoftechSolutions.com due to unauthorized use of your account, whether caused by you or your authorized person.

10. Additional Rights

RajSoftechSolutions.com reserves the rights to deny, cancel, suspend, lock or modify any or all accounts or services or even terminate any user access (including the rights to cancel or transfer any domain name registration) for any reason (as determined by RajSoftechSolutions.com at its sole discretion), including but not limited to the following conditions:

  i.) To correct the mistakes if happened in our services (including domain name registration)
  ii.) to protect the integrity and stability of our business
  iii.) to assist with fraud and abuse detection and prevention efforts
  iv.) to comply with local and international laws, rules and regulations
  v.) to comply with the requests of any law enforcement agency, including subpoena requests,
  vi.) To comply with any dispute resolution process
  vii.) to safeguard the public interest and rights defending any threatening action
  viii.) to avoid any civil or criminal liability on the part of RajSoftechSolutions.com, its officers, directors, staffs, employers, and agents, as well as our affiliates.

We reserve the right to review every account at the any frequency interval for excessive space and bandwidth utilization and to terminate or apply additional charges/fees to those accounts that exceed allowed levels. Your hosting account and data will be deleted post domain redemption period or after 15 days of your hosting account expiry and in this case, RajSoftechSolutions.com does not provide any guarantee for your data safety. Domain registration is subject to availability at the time of registration and RajSoftechSolutions.com does not hold any responsibility for any kind of failure during domain registration or domain transfer or hosting account transfer.

11. Dedicated, Semi-Dedicated and Virtual Private Servers

We reserve the right to reset the password on a dedicated server if the password on file is not current so that we may do security audits as required by our datacenter. It is the responsibility of the client to ensure that there is a valid email address and current root password on file for their dedicated server on file to prevent downtime from forced password resets. RajSoftechSolutions.com reserves the right to audit servers as needed and to perform administrative actions at the request of our datacenter. Dedicated servers are NOT backed up by us and it is the responsibility of the client to maintain backups or have a solution for this. You may purchase an additional hard drive and maintain backups to it as the most simple solution. Please contact sales@rajsoftechsolutions.com if you wish to obtain a secondary hard drive. It is your responsibility to maintain backups.

12. Price Change

The amount you paid at the first time of your account setup will never increase and in some exceptions, we reserve the right to change the prices listed on RajSoftechSolutions.com. We also hold the right to increase, decrease or modify the resources given to plans at any point in time including hosting services, digital marketing services and/or any other services listed on this site.

13. Discounts and Offers

Discounts and coupon codes are reserved for first-time accounts (or first-time customers) only and may not be used towards the purchase of a domain registration unless otherwise specified. If you have signed up using a particular domain, you may not resign up for that domain using another coupon at a later date. Any account found in violation of these policies will be reviewed by our sales department and the appropriate invoices will be added to the account. Coupon abuse will not be tolerated and may result in the suspension or termination of the account.

14. Trademarks and Copyright Laws

RajSoftechSolutions.com is committed to protecting the intellectual property. Further, The customer shall confirm that he/she will not infringe any intellectual property rights or other rights of any person or entity by using our services. Also, we cannot check any services or the use of our services under this agreement, infringes legal rights of others. In case of any notice received under DMCA for intellectual property violation, we reserve the right to remove the content with or without the prior to the customer, depending on the seriousness of the concerned issue.

15. Indemnification

Customer agrees that they shall defend, indemnify, save and hold RajSoftechSolutions.com and its officers, directors, employees, and agents, harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney’s fees, asserted against RajSoftechSolutions, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless RajSofechSolutions.com against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with RajSoftechSolutions.com; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from RajSoftechSolution’s server.

16. Links to Third-Party Websites

Our site and/or services on this site may contain links to any third-party websites that are not owned and/or controlled by RajSoftechSolutions.com and hence, we assume no responsibility for the contents and policies outside our website. By using our site or any services on this site, you openly hold any and all liability arising from your use of any third-party websites. However, we encourage and aware our users when leaving our site to read their various policies and other governing documents.

20. Governing Law

Customer agrees to use our services in compliance with applicable law and this Agreement and the annexed documents, which is hereby incorporated by reference in this Agreement. Further:

    a.) The Terms of Agreement and the relationship between you and us shall be governed by the laws of India. The Courts of law at Coimbatore, India shall have exclusive jurisdiction over any disputes arising under this agreement or other related issue arising out of the use of this site or related services. Our failure to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision.

    b.)
